Suffice to say, this question needs to be addressed with all urgency. Can two minors indulge in a consensual sexual relationship with each other?


Most sources say that consent of a minor for sexual intercourse cannot be considered legal consent in any way. We also need to note the fact that a minor/child in India refers to anyone below 18 years of age. This means that the age of consent-the legal age at which a person can give consent for sexual relationships is 18. This is relatively high in comparison to other countries of the world. The age of consent in the United Kingdom is 16, while the age of consent in The Philippines was until 2020, a surprising 12!


While some countries like India and the US have high age of consent, countries like The Philippines have low age of consent, thus, the mean age of consent is challenged by extreme values.


Snapping back to the topic, it is illegal for minors to indulge in any form of sexual relationship in India. Although this hasn’t stopped high school relationships from happening. It is all fun and games until sexual activities are involved.

Well, now we know that this is criminalized, but what is the punishment?


We can see that sex with a minor girl amounts to rape, irrespective of consent, this can lead to imprisonment for up to 7 years.

The age of consent is still a long-debated topic in India, with liberals pleading to decrease it, and conservatives trying to increase it.


There was once a suggestion by Madras High Court, in 2019, to exclude consensual sex with girls of 16 years and above from criminalization. This meant to remove or decriminalize consensual sex from the Prevention of Children from Sexual Offences (POCSO) Act. 

This suggestion was welcomed by legal experts who advocated its utility. The Court also suggested that the Age of Consent be brought down to 16 from the previous 18.

It is also noted that minor girls use their woman-card to frame their minor-male counterparts into the crime of sexual misconduct, even if it were done with complete consent from both parties.


The Indian society tends to side with the girl in such circumstances, thus strongly opposing the boy, this is an unfortunate reality in India today.

Laws must be uniform and not one-sided. Gender equality refers to equality of the genders and not the domination of females.


The POCSO Act is currently inclined or partial to females and tends to put males into a state of criminalization. Consensual sexual activity between teens aged 16 and above must be made a norm. This is because modern technology has facilitated more knowledge about sex and has leveraged quicker maturity among modern teens. Thus it is recommended that the Age of Consent be brought down to an appropriate 16 from the present 18.
